ICE in Hudson

On Saturday night, the following was reported on the Columbia County Sanctuary Movement's Facebook page:
ICE detained six people during a house raid in Hudson last night. Earlier this month they took another person from Hudson City Court with HPD's collaboration. This is a violation of due process and the Mayor and Police Commissioner's Executive Order. Sanctuary does not come from hollow words. It comes from bold action from below.
This morning, Rosa Acheson reports on both actions in the Register-Star: "6 from Guatemala detained."

  3. I'm actually interested to know what prompted the action and if there was a compelling reason HPD cooperated with ICE in violation of the (non-binding) Mayor's order.

    1. According to The Register-Star, on April 20th, "[a] man was detained on a U.S. warrant, signed by a federal magistrate."

      The Common Council Resolution of March 21 states that "the City of Hudson Police Department shall not engage, assist or support immigration enforcement except as follows .... (ii.) When such services are required to safely execute ... [a] court order issued by a state or federal court."

  4. The Columbia County Sanctuary Movement should tread carefully in making such statements, or else risks losing its credibility and efficacy.

  5. The group sacrificed its credibility months ago.

    In February, the "organizers" of the Columbia County Sanctuary Movement were asking people to "engage in direct actions aimed at disrupting" the federal raids.

    That was not treading carefully at all.

    "The crime of SOLICITATION is completed if one person intentionally entices, advises, incites, orders, or otherwise encourages another to commit a crime. The crime solicited need not actually be committed for solicitation to occur."

I'm not paying close attention, but having lived through the civil rights and anti-war movements of the 60s and 70s, it's good to remember what civil disobedience means: violating the law, risking jail, in order to make the point that the law is morally indefensible. What our immigrant friends need now is legal representation and I'm hoping the local Sanctuary movement has lawyers lined up for immediate action. It is no joke that from ICE arrest to deportation (on a plane to home country) is less than a day.

  7. Hi my name is Bryan MacCormack. I am the Executive Director of the Columbia County Sanctuary Movement. The Chief of Police was quoted saying there was a judicial warrant. If anyone can provide that warrant to back his claim I implore you to do so here, because to date it has not been presented in any legal proceedings or information requests. Only a criminal complaint. I am confident in our credibility, as our claims have been shaped by court proceedings, legal documents via discover and our legal committee which consists of allied organizations such as the ACLU and a plethora of private attorneys. I implore all the naysayers this thread to present a valid piece of information, rather than what they read in a register star article. It is not the resolution that is binding, it is the Mayor and Police Commissioner's executive order which pertains to city resources and includes the jail cell someone was held in, that backs our claims. It is a denial of due process because the individual was in court and taken (in collaboration with HPD) before he was able to have a hearing, before a conviction, and without a warrant. This is the 5th time in three months. When the HPD and city comply with our Freedom Of Information Law (FOIL) requests we will know even more. I ask you to care for your neighbors. I ask you to do your own research. And I ask you to stand for equal justice.

      "[Assistant U.S. Attorney Michael] Barnett confirmed an arrest warrant signed by a federal judge was also issued for the Contreras-Flores case, Barnett said Tuesday [5/23]" (Register-Star, May 24, 2017).

  8. Concerns have been raised here about the credibility of the Columbia County Sanctuary Movement. We'd like to bring attention to the important work of CCSM, much of which happens without public attention:

    Since late 2016, the Columbia County Sanctuary Movement, a multi-racial group of volunteers comprising immigrants, faith leaders, and allies has organized a rapid response team to support community members detained by ICE and their families; coordinated a legal team and a translation team to go into the jails and do intakes with those who have been detained; organized legal representation for detained community members; coordinated fundraising and food collection to support the families of those detained; connected families to services; and accompanied people to immigration appointments and ICE check-ins. They are developing relationships of trust, and building leadership and capacity within the communities most impacted. More publicly, CCSM successfully fought to pass the sanctuary city resolution in Hudson.

    In the past three months, twelve people have been detained in our city. It’s easy for those of us who aren’t personally impacted by ICE’s actions in Hudson to be silent while Brown people in our community are detained, families separated, neighbors forced to live in fear. We must remember the lessons of the past and stand with our community members against state-led oppression.

    This week, CCSM is asking us all to join in pushing the Mayor and the Police Commissioner to enforce their existing Executive Order; investigate apparent collaboration between the Hudson Police Department and ICE; and endorse a new Executive Order codifying the sanctuary city resolution passed by the Common Council.

    CCSM is doing what we all could be doing - standing up for the safety and protection of everyone in our community, especially those who live in such uncertainty.
