As Gossips previously reported, the Common Council went into executive session last night "to discuss litigation." When the Council came out of executive session, there was a vote. On a motion by Councilmember Margaret Morris (First Ward), seconded by Councilmember Ryan Wallace (Third Ward), the members present voted to authorize going forward with a Notice to Appeal related to the decision handed down last week by Acting Supreme Court Justice Henry F. Zwack in the lawsuit brought by A. Colarusso & Sons against the Hudson Planning Board. All members presented voted in favor; Councilmember Amber Harris (Third Ward) was absent.
Glad to see the City do the right thing. The ruling by Zwack is an ill-informed hack job by a judge who doesn't have any sense of the history and context of this case. I hope he gets shamed and embarrassed by a superior court.

ReplyDeleteNext, perhaps some or all of the appropriate City agencies will request that CEO Haigh halt Colarusso's unpermitted commercial dock operation.
It is the one point on which Judge Zack and Judge Melkonian agree, the right to continue operations has ceased.
This means that every gravel truck that travels across Front Street and up Columbia Street is a gift to Colarusso from the City of Hudson. All that it would take to stop the trucks for the remainder of the year is a request, which perhaps the Conservation Advisory Council will recommend to the Common Council. Or anyone!
Keep dreaming. They don't have the will to do it.

The full gravel Trucks come down Columbia and turn a dangerous 90 degrees onto N3rd. AKA 23B/9G
and never tighten nor close tarps properly, so we get dosed with silica plus truck fumes and damage from weight. More cracks in the foundation of our roads & homes.
Very few full trucks go down Columbia to Front St, so it's OK as long as they are on the truck route?
Don't they have another way to get their empty trucks back home? Are we going to get those also, or can Craigh Haigh shut down the whole dock operation, or is this just for Front St & 3 blocks of Columbia ,when they return with empty trucks?
I'm really asking, not being facetious.
We have our hands full with all the constant increase of huge longhaulers & huge delivery tractor trailers to Big Box Mall in Greenport,
or where ever else they're going.
